JamA11y Free End User Licence Agreement and Terms of Use

These JamA11y Free End User Licence Agreement and Terms of Use, the “Terms”, are a legal agreement between you, the individual or organisation using JamA11y, “you” or “User”, and JAMWORKS PLATFORM LIMITED, a company incorporated in England and Wales with company number 12578785, whose registered office is at Hop Fields, Tongham Road, Runfold, Surrey, United Kingdom, GU10 1PH, “Jamworks,” “we,” “us,” or “our.”
JamA11y is a software-as-a-service platform made available by Jamworks to assist users with PDF accessibility remediation, including PDF/UA-oriented processing and page-level remediation using credits.
By ticking the acceptance box, creating an account, uploading a document, or using JamA11y, you agree to these Terms. If you use JamA11y on behalf of an organisation, institution, employer, school, college, university, public body, or other entity, you confirm that you are authorised to accept these Terms on its behalf. If you are not authorised, or if you do not agree to these Terms, you must not use JamA11y.
1. What JamA11y does
JamA11y is designed to help users improve the accessibility of PDF documents. Depending on the features available to you, JamA11y may allow you to:
(a) upload PDF documents or other supported documents;
(b) process documents for PDF/UA-oriented output;
(c) use free monthly credits to perform full page-level remediation;
(d) download remediated or processed PDF outputs;
(e) view accessibility-related information, status indicators, reports, or issue flags; and
(f) access related account, usage, help, and product features.
JamA11y is provided as software. Unless we expressly agree otherwise in writing, JamA11y does not include manual remediation services, legal advice, accessibility consultancy, certification services, professional audit services, or human review by Jamworks of your documents.
2. Key definitions
In these Terms:
Account means the account you create to access JamA11y.
Credit means a usage unit for full remediation. Unless stated otherwise in JamA11y, one Credit allows full remediation of one page.
Document means any PDF or other supported file that you upload, submit, import, process, store, or otherwise use with JamA11y.
Free Plan means the free version of JamA11y made available by Jamworks from time to time.
Full Remediation means page-level processing intended to improve the accessibility of a PDF page, using Credits.
Output means any PDF, document, file, report, accessibility information, metadata, status, score, recommendation, or other output generated by JamA11y.
PDF/UA means the PDF/UA accessibility standard or related technical requirements for accessible PDF documents, as applicable to the relevant document and use case.
Service means JamA11y and any related software, website, platform, documentation, support materials, and features provided by Jamworks.
3. Licence to use JamA11y
Subject to these Terms, Jamworks grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use JamA11y for your own personal, educational, internal business, accessibility, administrative, or document-remediation purposes.
You must not:
(a) copy, modify, reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying models, workflows, algorithms, systems, or architecture of JamA11y;
(b) use JamA11y to build, train, benchmark, or improve a competing product or service;
(c) resell, rent, lease, sublicense, or commercially exploit JamA11y;
(d) use JamA11y as a service bureau, bulk remediation service, outsourced accessibility service, or commercial remediation service for third parties, unless we have agreed this in writing;
(e) bypass, disable, or interfere with usage limits, credit limits, account controls, security features, rate limits, or technical restrictions;
(f) use bots, scripts, scraping, automated uploads, bulk workflows, or API access unless expressly permitted by us;
(g) upload malware, viruses, harmful code, unlawful material, or content that infringes another person’s rights; or
(h) use JamA11y in any way that could damage, overload, disrupt, impair, or compromise the Service or our systems.
4. Free Plan and monthly Credits
The Free Plan includes 10 free Credits per calendar month, unless Jamworks states a different allowance in the Service.
Unless we state otherwise:
(a) one Credit equals one page submitted for Full Remediation;
(b) Credits are consumed when Full Remediation processing begins;
(c) unused free Credits do not roll over to the next month;
(d) free Credits have no cash value and cannot be sold, transferred, exchanged, refunded, or redeemed;
(e) free Credits are linked to your Account and may not be pooled across multiple Accounts;
(f) creating multiple Accounts to obtain additional free Credits is not permitted;
(g) once your free Credits are used, Full Remediation may be unavailable until your next monthly allowance is applied or until you purchase or receive additional Credits; and
(h) Jamworks may correct, reverse, or adjust Credit usage where we reasonably determine that a system error or misuse has occurred.
Jamworks may change, suspend, reduce, or withdraw the Free Plan, monthly Credit allowance, or any free functionality at any time. Where reasonably practicable, we will give notice by email, in-product message, website notice, or other reasonable method.
5. No automatic overage charges
The Free Plan is designed so that you should not incur automatic overage charges.
Unless you separately agree to paid terms, place an order, enter payment details for a paid plan, or expressly authorise additional paid usage:
(a) you will not be charged simply because you use all 10 free monthly Credits;
(b) JamA11y may stop or limit further Full Remediation once your Credits are exhausted;
(c) Jamworks may invite you to upgrade, purchase additional Credits, or enter a paid agreement; and
(d) any paid plan, purchased Credits, institutional licence, or enterprise arrangement may be subject to separate or additional terms.
6. Fair use
JamA11y’s Free Plan is provided for reasonable individual, educational, testing, evaluation, accessibility-support, and internal use. To keep the Free Plan available and reliable, you must use it fairly.
You must not:
(a) use the Free Plan for high-volume, bulk, automated, or commercial PDF remediation;
(b) use the Free Plan to remediate documents for unrelated third parties as a paid or unpaid service bureau;
(c) create or use multiple Accounts to avoid Credit limits, file limits, rate limits, or fair-use restrictions;
(d) split, merge, alter, or repeatedly upload documents to manipulate usage limits or Credit consumption;
(e) submit excessive, repetitive, artificial, machine-generated, test, or malicious workloads;
(f) run load tests, performance tests, security tests, vulnerability scans, scraping, or benchmarking without our prior written consent;
(g) use JamA11y in a way that materially exceeds normal free-user behaviour or threatens the security, availability, performance, or integrity of the Service; or
(h) upload documents that you do not have the right to process using JamA11y.
We may apply reasonable file-size limits, page limits, storage limits, processing limits, queue limits, rate limits, monthly usage limits, or other technical controls. These limits may be displayed in JamA11y or applied automatically.
If we reasonably believe that your use breaches this fair use policy, we may throttle, limit, suspend, queue, delete, or block processing, remove access to particular documents, suspend or terminate your Account, or require you to move to a paid plan.
7. Your documents and your responsibilities
You retain ownership of your Documents and Outputs, subject to Jamworks’ rights in the Service and underlying technology.
You grant Jamworks and its service providers a limited licence to host, copy, process, transmit, store, analyse, modify, convert, remediate, generate, and display your Documents and Outputs solely as necessary to provide, secure, maintain, troubleshoot, and improve the Service in accordance with these Terms and our privacy commitments.
You are responsible for:
(a) ensuring that you have all rights, permissions, licences, consents, and lawful bases needed to upload and process Documents using JamA11y;
(b) ensuring that your use of JamA11y complies with laws, policies, contracts, and rules that apply to you;
(c) keeping backup copies of your original Documents and Outputs;
(d) checking and validating Outputs before using, publishing, sharing, or relying on them;
(e) deciding whether a document is suitable for distribution, publication, education, accommodation, compliance, procurement, legal, or public-facing purposes; and
(f) responding to any accessibility requests, accommodation obligations, complaints, or legal requirements that apply to you or your organisation.
You must not upload Documents containing information that you are not permitted to share with Jamworks. You should avoid uploading unnecessary sensitive personal data. You must not upload payment-card data, government-classified information, export-controlled information, malware, or unlawful content. You must not upload protected health information subject to HIPAA unless Jamworks has separately agreed to that in writing.
8. Accessibility and PDF/UA limitations
JamA11y is designed to assist with PDF accessibility remediation and PDF/UA-oriented output. However, automated remediation has limitations.
You acknowledge and agree that:
(a) JamA11y does not guarantee that any Document or Output will be 100% accessible;
(b) JamA11y does not guarantee that any Output will fully comply with PDF/UA, WCAG, Section 508, the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, any institutional accessibility policy, or any other accessibility law, regulation, standard, or requirement;
(c) JamA11y does not provide legal advice, compliance advice, certification, or a formal accessibility audit;
(d) different accessibility checkers, PDF viewers, browsers, assistive technologies, operating systems, learning management systems, and user settings may produce different results;
(e) automated reports, scores, status indicators, issue flags, tags, reading-order suggestions, alt-text suggestions, or other accessibility information generated by JamA11y may be incomplete, inaccurate, or require human judgment by you or your organisation;
(f) some issues require contextual judgment, including alternative text, reading order, headings, table structure, document language, form labels, captions, long descriptions, mathematical notation, charts, maps, diagrams, and the intended use of the document; and
(g) you are responsible for reviewing Outputs and deciding whether further remediation, manual checking, alternative formats, or accommodations are required.
JamA11y may be unable to fully process or remediate certain files, including scanned documents, image-only PDFs, handwritten documents, poor-quality scans, encrypted files, password-protected files, corrupted files, malformed PDFs, digitally signed PDFs, documents with complex tables, forms, mathematical notation, charts, maps, scripts, embedded media, or documents generated from inaccessible source material.
9. Changes after remediation
Jamworks is not responsible for accessibility issues introduced after JamA11y processes a Document, including issues caused by:
(a) editing, compressing, flattening, printing, scanning, redacting, signing, locking, splitting, merging, or converting an Output;
(b) uploading an Output to a third-party platform that changes the file;
(c) distributing the wrong version of a file;
(d) using unsupported PDF viewers, browsers, learning management systems, content management systems, document repositories, or assistive technologies; or
(e) changing the document’s content, structure, tags, metadata, reading order, or layout.
10. Availability, support, and changes to the Service
The Free Plan is provided without any guaranteed availability, uptime, service level, support response time, or support commitment.
Jamworks may update, improve, modify, suspend, withdraw, or discontinue all or part of JamA11y at any time. We may also change remediation logic, PDF/UA processing methods, accessibility checks, reporting, Credit usage rules, technical limits, or supported file types.
We may perform maintenance, apply updates, suspend access, or limit processing where needed for security, availability, compliance, abuse prevention, product improvement, or operational reasons.
11. Privacy and data protection
Jamworks will process personal data in accordance with its privacy notice and applicable data protection laws.
Where you upload Documents containing personal data, you are responsible for ensuring that you have the right to provide that personal data to Jamworks for processing through JamA11y.
Jamworks will use reasonable technical and organisational measures designed to protect Documents and personal data processed through JamA11y. However, no online service is completely secure, and you should not upload Documents that you are not comfortable processing through a cloud-based service.
Jamworks will not sell your Documents or personal data. Jamworks will not use your Documents or Authorised User data to train artificial intelligence models unless you have expressly agreed to this.
Jamworks may use subprocessors and service providers to operate JamA11y, including hosting, security, analytics, support, storage, and processing providers. Jamworks remains responsible for its subprocessors as required by applicable law.
Jamworks may delete Documents, Outputs, logs, or account data after a reasonable period, in accordance with its retention practices, product settings, legal obligations, and operational requirements. The Free Plan should not be used as a document storage or archive service.
12. Confidentiality
Your non-public Documents are your confidential information. Non-public information about JamA11y, including its software, workflows, security information, pricing, roadmap, performance, and product design, is Jamworks’ confidential information.
Each party must use the other party’s confidential information only as necessary for use or provision of JamA11y and must take reasonable steps to protect it from unauthorised disclosure.
This does not apply to information that is already public, independently developed, lawfully received from another source, or required to be disclosed by law.
13. Intellectual property
Jamworks and its licensors own all rights in JamA11y, including the software, platform, workflows, models, algorithms, interfaces, designs, documentation, know-how, trademarks, and underlying technology.
These Terms do not transfer any Jamworks intellectual property rights to you.
You must not remove Jamworks branding, notices, watermarks, metadata, proprietary notices, or usage controls from JamA11y or any Output where those notices are included by the Service, unless Jamworks allows this.
If you provide feedback, suggestions, ideas, or recommendations about JamA11y, Jamworks may use them without restriction or payment to you, provided that we do not disclose your confidential information in doing so.
14. Third-party services
JamA11y may use, link to, integrate with, or allow access to third-party websites, platforms, tools, software, or services.
Jamworks is not responsible for third-party services, third-party terms, third-party content, or third-party changes. Your use of third-party services may be subject to separate terms and privacy notices.
15. Warranties and disclaimers
JamA11y is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Jamworks disclaims all warranties, representations, conditions, and guarantees, whether express, implied, statutory, or otherwise, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, availability, uninterrupted use, error-free operation, accessibility compliance, and legal compliance.
Without limiting the above, Jamworks does not warrant that:
(a) JamA11y will meet your requirements;
(b) JamA11y will be uninterrupted, secure, error-free, or available at all times;
(c) Outputs will be accurate, complete, compliant, or suitable for any particular purpose;
(d) any Document or Output will comply with PDF/UA or any accessibility law, standard, policy, or requirement;
(e) all accessibility issues will be identified or fixed;
(f) JamA11y will work with every PDF viewer, browser, operating system, learning management system, content management system, checker, assistive technology, or user setting; or
(g) data transmitted through the internet will be free from delays, failures, loss, corruption, or security risks.
16. Limitation of liability
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Subject to the above, Jamworks will not be liable for:
(a) loss of profits, revenue, business, contracts, anticipated savings, goodwill, or reputation;
(b) loss, corruption, deletion, or unavailability of data, Documents, or Outputs;
(c) costs of substitute services, manual remediation, accessibility audits, legal advice, accommodations, alternative formats, regulatory responses, complaints, settlements, or third-party remediation;
(d) fines, penalties, claims, complaints, investigations, or legal costs relating to your accessibility obligations;
(e) indirect, consequential, special, incidental, exemplary, or punitive damages; or
(f) losses arising from your use, publication, distribution, approval, rejection, editing, or reliance on any Output.
For the Free Plan, Jamworks’ total aggregate liability arising out of or in connection with these Terms or JamA11y shall not exceed £100.
For any paid self-service usage not governed by a separate written agreement, Jamworks’ total aggregate liability shall not exceed the amount you paid to Jamworks for JamA11y in the 12 months before the event giving rise to the claim.
17. Your indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Jamworks, its officers, employees, contractors, licensors, and service providers from and against any claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of or connected with:
(a) your Documents or Outputs;
(b) your breach of these Terms;
(c) your unlawful use of JamA11y;
(d) your infringement or alleged infringement of any third-party rights;
(e) your use, publication, distribution, representation, or reliance on any Output; or
(f) your failure to comply with accessibility, privacy, education, employment, procurement, or other laws that apply to you or your organisation.
18. Suspension and termination
You may stop using JamA11y at any time.
Jamworks may suspend or terminate your Account or access to JamA11y at any time if:
(a) you breach these Terms;
(b) your use creates security, legal, operational, reputational, or availability risk;
(c) your use breaches the fair use policy;
(d) you attempt to avoid Credit limits or technical controls;
(e) Jamworks is required to do so by law or a third-party provider;
(f) your Account is inactive; or
(g) Jamworks withdraws or changes the Free Plan.
On termination, your right to use JamA11y ends immediately. Jamworks may delete your Documents, Outputs, Account data, and usage data in accordance with its retention practices and applicable law.
Clauses that by their nature should survive termination will survive, including clauses relating to ownership, confidentiality, disclaimers, limitation of liability, indemnity, and data deletion.
19. Changes to these Terms
Jamworks may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, which may include email, in-product notice, or website notice.
Your continued use of JamA11y after updated Terms become effective means that you accept the updated Terms. If you do not agree to the updated Terms, you must stop using JamA11y.
20. Enterprise and institutional agreements
If your organisation has entered into a separate written agreement with Jamworks for JamA11y or Jamworks services, that separate agreement will govern to the extent it conflicts with these Terms.
These Terms are intended for self-service access to JamA11y, including the Free Plan. They are not intended to replace a negotiated institutional service agreement, data processing agreement, procurement agreement, or enterprise order form.
21. Assignment
You may not assign, transfer, or sublicense your rights or obligations under these Terms without Jamworks’ prior written consent.
Jamworks may assign, transfer, subcontract, or delegate its rights or obligations under these Terms, provided that doing so does not materially reduce your rights under these Terms.
22. General legal terms
These Terms are the entire agreement between you and Jamworks for your use of JamA11y under the Free Plan, unless you or your organisation has a separate written agreement with Jamworks.
If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will continue in effect.
Jamworks’ failure to enforce any part of these Terms does not waive its right to do so later.
Nothing in these Terms creates a partnership, joint venture, employment relationship, agency relationship, or fiduciary relationship between you and Jamworks.
No person other than you and Jamworks has rights under these Terms.
The subjects of governing law, dispute resolution, litigation forum, and arbitration are intentionally not specified in these Terms unless addressed in a separate written agreement or required by mandatory law.

24. Acceptance
